Caltrans sued over minority contract program - Los Angeles Business from bizjournals:

Pacific Legal Foundation attorneys filed the lawsuit on behal of theof America, San Diego Chaptefr Inc. The nonprofit corporation takes issuewith Caltrans’ 2009 Disadvantaged Business Enterprise Program, which Caltranx announced in a memo to transportation-related agenciex March 4. The program sets a quotaw of having 6.75 percent of federally funded road and highwat project contracts go to women or members ofcertain groups, including African Asian-Pacific Americans and Native Americans, according to the Pacific Legal Foundation.
“Caltrans is sideswipingv the important principle of equal opportunity byusing race, not lowestg cost by a responsible bidder, to decide who gets government road and highwayy contracts,” PLF principal attornet Sharon Browne said in a news “Caltrans’ scheme of coding contractors by color is not only unfaifr and wasteful of tax dollars, it is flat-out The PLF alleges that program violates equal rights as guaranteed by Propositiohn 209, approved by votersw in 1996. It bars race- or sex-based preferencez or discrimination inpublic contracting, employment and Caltrans spokesman Benjamin DeLanty said the agency had no immediates comment.
He said Caltranz officials had not seen the lawsuit and need time toreview it.
