The sale was the latesg move in an agreement the two parties signed at the end of last year for Microme t to offer upto 10.5 million shares to Kingsbridge if it wished, in return for as much as $75 millionn in potential funding through Dec. 1, 2011. Microme t (NASDAQ: MITI) sold the stock this montuh at a discount of 10 percenr to 12 percentper share. By the end of the tradinv period on June 15 underethis agreement, Micromet’s shares were $4.38. The business, which qualifies for the Sectiom 8(a) minority contracting program, also complained that Informatio n Technology Experts was allowed to submit pricin g forthe contract's four optionakl years after oral presentations even though others were not give n that opportunity and the solicitation required the written proposal to includew the details. The Government Accountability Office (GAO), whichb evaluates bid protests, agreed with GAITaS on all counts.

"GAITd wasn't taking advantage of the positioh they had asan incumbent," Dugan says.
"The y could have come up with specifics of how to do it even andthey didn't do it." Information Technology Expertds would have won even if the department didn't take the steps the GAO identifiedr as improper, she says. The GAO is not so sure abou that. "A correct evaluation of the GAITS proposal could have resulted in the firm being considered to have submitte the proposal deemed technicallysuperiodr overall," the decision reads.

Housed Bill 952 essentially takes away the rightt of workers to vote by secret ballot on whether or not they woulrd want to join a replacing it with the authorization If a majority ofa company’s workeras sign the cards, the unionb would automatically be recognized and free to bargaihn with management. The legislation is a coup for Hawaii’x labor unions who have said the card-check proceses is simply meant to streamline the presengt system and make itless coercive. But Wednesday’s override is perhaps one of biggestfears realized.
